Alberta Threatens Judicial Funding Freeze Over Appointment Powers

Province Demands Federal Consultation on Judge Selection

Alberta Premier Danielle Smith has declared the provincial government will withhold funding for new judicial positions unless Ottawa grants greater involvement in federal judge appointments. In correspondence made public Tuesday, Smith outlined demands for reforming how justices are selected for provincial and national courts.

Appointment Process Reform Demanded

The Premier’s letter to Prime Minister Mark Carney proposes establishing a joint committee with provincial appointees to assess candidates for Alberta’s Court of King’s Bench, Alberta Court of Appeal, and Supreme Court of Canada nominations. Government officials indicate this structure would ensure judicial selections “appropriately reflect Alberta’s distinct legal traditions.”

“Alberta’s government will not agree to provide the necessary funding to support any new judicial positions in the province until such engagement and collaboration are provided,” Smith stated in the January 23 communication.

Bilingualism Requirements Challenged

The province simultaneously called for relaxed bilingualism requirements for federal judicial appointees, contending these requirements create barriers and contribute to Western alienation. Officials argue linguistic policies should accommodate regional realities beyond Eastern Canada.

This move follows recent tensions between Alberta’s government and the judiciary after the Premier suggested wanting greater influence over judicial decisions. Court representatives previously emphasized the constitutional importance of judicial independence.

Smith’s letter maintains that provincial involvement would “strengthen public confidence in the administration of justice” while ensuring rulings align with Albertan values. The federal government has not yet issued a formal response to the funding ultimatum.
