Fence Damage? Legal Expert Guides on Neighbor Tree Issues

Homeowners facing fence damage due to a neighbor’s tree or plants now have clear guidance on how to proceed. As warmer weather encourages garden attention, some may discover encroaching greenery causing structural issues.

Addressing Neighboring Plant Encroachment

Legal and property specialists have previously addressed concerns about overhanging branches and property line disputes. However, a specific set of steps is recommended when a neighbor’s tree or shrubbery is causing actual physical damage to your fence.

Initial Steps for Fence Damage

Jagdeep Sandher, a partner and head of civil litigation at Blythe Liggins Solicitors, outlined the crucial initial actions. “The first step is to make sure you’re absolutely certain that it is your fence and not theirs,” Sandher stated. He advises checking property title documents or consulting a boundary surveyor or solicitor if ownership is unclear.

Following confirmation of ownership, Sandher emphasizes a direct, calm approach. “When you’re certain, I’d always advise speaking to your neighbour in a calm and collected way about it. You’ve always got to have in the back of your mind that you will continue living next door to this person for potentially many years to come, so you need to keep relations neighbourly.”

Formalizing Your Position

If an informal conversation does not resolve the issue, the next course of action involves formal communication. “You then need to formally set out your position in writing to the neighbour, whether you do that personally or through a solicitor,” Sandher explained.

Should a dispute arise regarding fence ownership or boundary lines, a surveyor would typically be involved to determine these facts. If an agreement cannot be reached directly, seeking legal advice and initiating legal action to recover repair or replacement costs from the neighbor is the subsequent step. Sandher noted that the formal involvement of a solicitor’s letter often prompts a resolution to avoid costly court proceedings.

Overhanging Branches Without Damage

For situations where a neighbor’s tree or hedge simply overhangs your garden without causing damage, specific rights and responsibilities apply:

  • You are entitled to trim back branches up to your property boundary line, but not beyond it.
  • Entering a neighbor’s garden to cut branches on their side of the boundary, or without permission, is not permitted.
  • The responsibility for disposing of any trimmed branches falls to you.
  • It is advisable to discuss your intentions with your neighbor politely.
  • Verify that the tree is not subject to any protection orders, such as a tree preservation order.

It is important to note that a neighbor is not obligated to trim their tree simply because it crosses your boundary or appears unsightly. Their responsibility to take action is primarily triggered if the tree becomes dangerous or is considered a nuisance.
