Tess Ogara, who dedicated over 40 years to her profession, discovered her life savings were gone when she received an email from liquidators just two days before she was due to access her retirement funds.

The email, received in April 2025, informed Ms. Ogara that Falcon Capital, an entity linked to her investment, had gone into liquidation. Initially confused, she soon realized that her substantial superannuation savings were tied up with the firm and no longer accessible. This discovery came as a profound shock, shattering her carefully laid retirement plans.

Ms. Ogara is among approximately 6,000 investors affected by the significant collapse of the First Guardian Master Fund and Shield Master in May 2024, a failure that reportedly involves around $1.2 billion. The timing of the loss is particularly cruel, as Australians typically gain unrestricted access to their superannuation upon reaching age 65.

Misleading Investment Advice

Ms. Ogara stated that she was initially sold the investment as a diversified product. However, she later learned that over 90 percent of her retirement funds had been channeled into a single firm, Falcon Capital, through First Guardian. She expressed significant anger towards the financial advisor who structured the investment in this manner without adequately disclosing its high-risk nature.

The Australian Securities and Investments Commission (ASIC) has since confirmed Ms. Ogara’s loss at $538,000. Her claim is currently under assessment by the Compensation Scheme of Last Resort (CSLR). While the CSLR offers a maximum payout of $150,000, this would still leave Ms. Ogara facing a shortfall of hundreds of thousands of dollars.

Devastating Impact on Retirement Plans

The loss has fundamentally altered Ms. Ogara’s retirement prospects. She had wrongly assumed that Australian retirement savings were effectively guaranteed by the federal government. The emotional toll has been immense, with Ms. Ogara describing sleepless nights and months of replaying how she ended up in such a dire financial position.

To manage her finances, Ms. Ogara has been forced to rent out a room in her home. She faces substantial monthly interest payments on her mortgage, which she had anticipated paying off by retirement. She estimates having paid over $33,000 in interest since turning 65 on a mortgage she believed would be cleared. Ms. Ogara now believes she will need to continue working for at least another decade and may have to rely on the pension, leaving her beneficiaries with debt instead of financial security.

Regulatory Action and Investor Advocacy

ASIC is actively pursuing multiple investigations into the conduct of First Guardian Master Fund and its directors. Allegations include directors siphoning millions of dollars from the fund into personal bank accounts and moving substantial sums offshore upon learning of investigations. Reports indicate that one director allegedly purchased a $9 million mansion and another a $548,000 Lamborghini using funds from the scheme.

Liquidators have so far recovered only a fraction of the $1.2 billion lost, with approximately $1.6 million accounted for. This minimal recovery rate has intensified concerns among investors about the potential for recouping any of their lost savings.

Melinda Kee, an investor in the collapsed funds and leader of the advocacy group SOS Save Our Super, is campaigning on behalf of the approximately 12,000 Australians affected. Ms. Kee highlights the widespread distress caused by these collapses, including postponed retirements, inability to support family, marital strain, and severe mental health impacts, with some individuals contemplating suicide.

A Call for Systemic Change

Ms. Kee argues that the current situation demands a shift in focus from legal proceedings to parliamentary action. She contends that Australia’s superannuation laws have not kept pace with the scale of modern financial collapses, leaving thousands of investors vulnerable. The ongoing nature of investigations and the prolonged waiting periods for answers exacerbate the hardship faced by affected families.

Ms. Ogara, reflecting on her experience, emphasized her typically cautious financial approach. She never gambled and adhered to the principle of not risking money she couldn’t afford to lose. However, she was unaware of the true risks associated with her superannuation investment, having believed it to be a secure vehicle for long-term savings.
