Sailing Icon Claims High-Stakes Confrontation Over Team Assets

Sir Ben Ainslie has alleged that he was warned by representatives of Sir Jim Ratcliffe that his business interests would face severe repercussions unless he surrendered valuable team assets and intellectual property. These claims have emerged in documents filed at the High Court.

The alleged threat, described as a warning that Ratcliffe would “burn your house down,” was reportedly conveyed by Jean-Claude Blanc, the chief executive of Ineos Sport, and Rob Nevin, its chairman. The confrontation is said to have taken place at Ainslie’s office in Barcelona in October 2024, mere hours before a significant America’s Cup race for Ainslie’s team.

Sir Jim Ratcliffe, the co-owner of Manchester United, had been a key financial backer for Ainslie’s America’s Cup campaign, investing substantial funds into the project. Britain had been aiming to secure this prestigious competition for the first time in its 175-year history.

Allegations of “Scorched Earth” Tactics

According to the court filings, Blanc and Nevin informed Ainslie that Ratcliffe’s continued funding for future America’s Cup endeavors was contingent upon the transfer of “all of [the team’s] assets and intellectual property.” The implication was clear: refusal would jeopardize the future of Ainslie’s Athena team.

Ainslie alleges that Nevin explicitly stated, “We have a phrase at Ineos: ‘scorched earth’. It means that if you don’t give Jim what he wants, he will burn your house down.”

The legal documents further detail Ainslie’s attempts to de-escalate the situation by pointing out the imminent start of the first AC37 race. However, Nevin is reported to have reiterated and expanded upon his threat, referencing a past instance where Sir Jim had only relented in a dispute concerning the People’s Republic of China.

The filing suggests that Ineos was aware its actions could significantly distract Sir Ben from his crucial race preparations, potentially harming Athena’s performance and its chances of winning the America’s Cup.

Legal Battle Over Team Assets

These serious allegations have been put forth by Britain’s most decorated sailor as he defends himself against a High Court action initiated by Ratcliffe’s Ineos. The legal challenge seeks to compel Ainslie’s Athena Racing squad to hand over a racing yacht, valued at approximately £180 million, which was jointly constructed for a previous America’s Cup competition.

Ineos lodged its claim in April, asserting that after providing around £174 million in funding for the design, construction, and testing of the yacht and related assets, they were entitled to ownership upon the agreement’s expiry. The filing contends that Athena Racing has wrongfully refused to transfer these assets and disputed its contractual obligation to do so.

In its defense filings, Athena Racing has accused Ratcliffe and Ineos of employing “undue commercial pressure” through “hostile negotiating tactics.” The team has also alleged “false imprisonment,” claiming that Ainslie and his associates were confined within their Northamptonshire headquarters following the parties’ separation.

Breach of Agreements and Competitive Intentions

Furthermore, it is alleged that Ineos violated a non-compete agreement by declaring intentions to compete in the 38th America’s Cup. This announcement was reportedly made in collaboration with former technical partners Mercedes F1, and Ineos subsequently denied Athena access to their simulator facilities.

Ainslie’s defense is being mounted against Ineos Racing Limited. However, the four-time Olympic gold medalist has specified in the filing that the claimant is ultimately controlled and directed by Sir Jim Ratcliffe and the broader Ineos Group.

The claims presented in the filing are contained within a section titled: “The Claimant does not come to equity with clean hands.”
