MoD Faces Maximum Sanction After Tank Explosion Kills Two Soldiers

The Ministry of Defence (MoD) has been issued the most severe sanction available following an investigation into a fatal tank explosion that claimed the lives of two soldiers and left two others injured. The Health and Safety Executive (HSE) has authorized a Crown Censure against the MoD and initiated prosecution against a defense contractor, Rheinmetall BAE Systems Land Ltd. This action stems from an incident on June 14, 2017, at Castlemartin Range in Pembrokeshire, where an L30 gun on a Challenger 2 tank exploded, resulting in the deaths of Corporal Darren Neilson, 31, and Corporal Matthew Hatfield, 27. One of the other soldiers sustained life-altering injuries.

Understanding the Sanctions: Crown Censure and Prosecution

It is crucial to note that neither the authorization of criminal charges nor a Crown Censure constitutes a finding of guilt. The HSE clarified that these actions are based on allegations following their investigation.

The Role of the MoD and Rheinmetall BAE Systems Land Ltd

According to the HSE, Rheinmetall BAE Systems Land Ltd was responsible for developing the safety case for the Challenger 2 tank and its L30 gun. However, the Ministry of Defence held the ultimate accountability for the health, safety, and welfare of its service personnel, as well as for ensuring the adequacy and suitability of the safety case presented.

Limitations on Prosecuting Government Bodies

Government departments like the MoD cannot be prosecuted in the same manner as private or commercial entities. Consequently, a Crown Censure represents the highest level of sanction that a government body can receive from the HSE. This censure is being issued under Section 2 of the health and safety act, alleging a failure to ensure the health, safety, and welfare of soldiers.

The Investigation and Legal Proceedings

The HSE’s investigation involved its inspectors gathering evidence, which was subsequently reviewed by the HSE’s legal services division. Following this review, and in accordance with the code for Crown prosecutors, the decision was made to proceed with the censure and prosecution.
