NSW Coroner Urges Stricter Gun Laws After Yamba Father-Son Shooting

A New South Wales coroner recommends enhanced firearms regulations following a tragic murder-suicide in Yamba. Wayne Smith fatally shot his 15-year-old son, Noah Smith, before taking his own life at their home on June 1, 2023.

Authorities reveal that Smith’s firearms license, previously suspended due to mental health issues, was restored just six months before the incident.

Complex Family Dynamics

Magistrate Teresa O’Sullivan highlights the deep bond between father and son, despite strains from Wayne Smith’s declining mental health. “Wayne’s deteriorating mental health necessarily affected Noah,” she states. “At times, he accepted responsibilities far beyond what would be expected of a young person.”

Noah lived an active life as a beloved son, grandson, and friend. Investigators find no prior threats or mistreatment in this filicide case, attributing the event to a combination of stressors impacting the 58-year-old’s well-being.

Key Recommendations for Safer Gun Ownership

Magistrate O’Sullivan issues seven recommendations to NSW Police Minister Yasmin Catley and Police Commissioner Mal Lanyon. These include:

  • A legal requirement for doctors to notify police about patients with firearms who raise mental health concerns.
  • Encouragement for general practitioners to ask patients about gun ownership.
  • Mandatory mental health risk assessments from doctors and psychologists for license applicants with a history of suicidal ideation.
  • Stricter evidence standards for firearms license applications or renewals related to recreational hunting or vermin control.

“This was an important inquest, and some important recommendations have been made as a result,” Magistrate O’Sullivan notes.

The NSW Police Minister and Commissioner have been approached for comment.
