Bull Rider Clay Hall Rape Trial: Closing Arguments Presented

Closing arguments have been delivered in the rape trial of competitive bull rider Clay Benjamin Hall, who stands accused of sexually assaulting a teenage girl. The trial, held at Warwick District Court, centers on an alleged incident that occurred in the early hours of October 2021 in Warwick, a town located approximately 160 kilometers southwest of Brisbane.

Allegations and Key Issues

Prosecutors contend that Mr. Hall, now 26, met the then-teenager on a street in Warwick. The court heard that the girl, who had been drinking and attended a house party prior to meeting Mr. Hall, offered to show him a shortcut to the Warwick Showgrounds. Mr. Hall was in town to support his brother at the Warwick Rodeo but was not competing due to an injury. He had also reportedly been drinking before heading out for food.

The central question before the jury, as articulated by Crown prosecutor Samantha O’Rourke, is whether the encounter was consensual. Ms. O’Rourke argued that Mr. Hall initiated sexual advances when the girl did not reciprocate his desire for sex, proceeding with the act regardless. She described the interaction as lacking any romantic preamble, stating there was “no kissing, no hand holding, nothing romantic in the build-up.”

The prosecution alleges that after walking past the girl’s home and through a fence towards the showgrounds, Mr. Hall made a sexual proposition. Instead of a direct refusal, the girl reportedly stated she needed to use the restroom as a “subtle non confrontational way” to decline. Ms. O’Rourke told the court that Mr. Hall persisted, leading to the alleged rape against a tree, encompassing both vaginal and anal penetration.

Defence Arguments and Hall’s Account

Defence barrister David Jones KC acknowledged that vaginal sex between Mr. Hall and the girl was not disputed. However, he contested the allegation of anal penetration.

The court reviewed a police interview with Mr. Hall conducted in 2023. In the recording, Mr. Hall recounted propositioning the girl and initially receiving no verbal response. He stated he offered to leave, but the girl allegedly responded, “Nah it’s alright.” Mr. Hall then said, “I said we can do something or I can leave. When she said yes, we started to touch each other.”

Mr. Hall told police he asked the girl to bend over against a tree before they engaged in sexual activity. He described the encounter as brief, lasting approximately 10 to 15 seconds, before the girl began to cry. “We started, then she started crying and I did stop,” Mr. Hall said in the interview. He recounted asking what was wrong, to which she replied, “I don’t know.” Mr. Hall stated he then decided to leave, saying, “OK, I’m going to go back to the rodeo grounds.” He recalled walking in one direction and the girl walking in the opposite direction.

Evidence and Reliability Concerns

The defence raised questions about the thoroughness of the police investigation, noting that while the girl was tested for alcohol, her blood alcohol concentration was found to be below 0.1, and she was not tested for drugs during her hospital examination.

Evidence was also presented from the girl’s boxing trainer, whose identity is protected for legal reasons. The trainer testified to receiving multiple calls from the girl on the night of the alleged incident. “She was in tears really bad,” the trainer stated, recounting the girl’s assertion that she had been raped. The trainer remained on the phone, helped locate the girl, and drove her to the hospital, offering her the choice between going to the hospital or the police, with the girl opting for the hospital.

During questioning, the trainer recalled several earlier phone calls from the girl that evening, including one during her walk with Mr. Hall and another during their discussions. The trainer described the phone audio as muffled, suggesting the phone was held low, and that the girl could be heard speaking with a man before the call disconnected. The trainer also revealed that the girl had mentioned a “significant sexual encounter” at the house party earlier that night. She reportedly could not recall this encounter and did not mention it to the police, a point the defence highlighted as casting doubt on her testimony’s reliability.

Prosecution’s Rebuttal

In response, the prosecution emphasized the repeated calls the girl made to her trainer while she was with Mr. Hall. Ms. O’Rourke described these calls as “the most compelling” evidence, suggesting they represented the girl’s attempt to seek help and alert someone to her situation. The prosecutor argued that Mr. Hall’s actions prevented her from receiving assistance, leaving her isolated.

The jury has heard all evidence and arguments and will now deliberate on the charges against Clay Benjamin Hall, who has pleaded not guilty to two counts of rape.
