Radio Host Seeks Additional Millions in Ongoing Legal Battle

Jackie ‘O’ Henderson is pursuing an additional $3 million from the Australian Radio Network (ARN) as her legal dispute with the company escalates. The prominent radio personality, formerly co-host of ‘The Kyle and Jackie O Show,’ is currently embroiled in a significant legal conflict concerning the termination of her substantial $100 million contract. The latest development involves a new claim for the repayment of a loan agreement.

New Loan Repayment Claim Filed

Documents lodged with the Federal Court reveal that Henderson is asserting a breach of a $3 million agreement. This agreement involved shares in the company being purchased on her behalf. According to the amended statement of claim, it was an explicit term of the agreement that a specific entity would provide Henderson Media with a limited recourse loan of $3,000,000 for the express purpose of acquiring ordinary shares in ARN.

Henderson’s legal team asserts that she entered into this loan arrangement with ARN in October 2023. Under the terms, ARN was reportedly only authorized to sell these shares on behalf of Henderson and her company, Henderson Media, in the event of her termination or breach of the agreement. However, legal representatives for the radio star allege that ARN proceeded to sell the shares on April 29 to recoup the loan, characterizing the situation as a ‘bad leaver’ event.

Henderson’s lawyers have stated that the basis for ARN’s Board determining a ‘bad leaver’ event occurred was not outlined. Henderson maintains that she did not terminate or breach the loan agreement and is seeking compensation, alleging that ARN acted in breach of this deal.

Medical Examination Mandated in Legal Action

This new claim follows previous reports that Henderson will be required to undergo a medical examination as part of her ongoing legal action against ARN. Court documents released indicate that this examination is to be conducted by a qualified medical expert chosen by ARN. The network is then obligated to submit an affidavit from this expert by August 6.

The 51-year-old radio host initiated a Fair Work claim against ARN in April, shortly after her radio contract was terminated. This followed a notable on-air dispute with her former co-host, Kyle Sandilands. Henderson has alleged that ARN failed to provide a safe workplace and adequately minimize psychosocial risks, stemming from several complaints she made against Sandilands.

Representatives for Henderson have confirmed this week that the court case will proceed, even though Sandilands recently reached a settlement with ARN for $12.09 million.

Contractual Disputes and Settlement Expectations

Henderson’s pursuit of an $82 million payout is reportedly facing increased scrutiny, with some sources suggesting her final settlement could be considerably less than Sandilands’s. Sandilands’s settlement, which included advertising contra, has reportedly influenced expectations regarding potential payouts for Henderson as her Federal Court case continues.

Sandilands’s payout is understood to approximate one year’s salary under his contract. This contract reportedly included a substantial base fee, a signing-on bonus, and a one-off payment. Henderson’s contract with ARN may not feature similar additional components, potentially placing her settlement in the range of $7.5 million to $10 million if an agreement is reached.

Henderson is suing ARN for wrongful termination, contending that her dismissal violated the Fair Work Act. A central point of contention is ARN’s assertion that Henderson herself initiated the end of ‘The Kyle & Jackie O Show’ after raising concerns about psychosocial health, safety, and bullying in relation to Sandilands. Henderson disputes this, insisting she did not resign, despite ARN’s prior statement that she had indicated she could no longer work with her co-host.

The two parties also remain in disagreement over whether an alternative program was ever offered to Henderson, a claim her legal team refutes.
